Terms of Service

1. Acceptance of Terms

By accessing or using Zobooma ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. Zobooma provides a platform for creating and managing performance-based marketing contracts between businesses and marketers, with escrow and AI-verified arbitration.

2. Description of Service

Zobooma enables users to create contracts that define marketing goals (e.g., keyword rankings, domain authority, AI visibility), set bounty amounts, and hold funds in escrow. Achievement is verified via third-party data sources (SerpAPI, Moz, OpenRouter, AI citation checks). Payouts are released only when goals are met and sustained per contract terms.

3. Account and Eligibility

You must be at least 18 years old and legally able to enter into binding contracts to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information when registering.

4. Stripe Connect

Escrow and payouts are processed through Stripe Connect. By connecting your Stripe account, you agree to Stripe's terms and policies. Zobooma does not hold funds directly; Stripe manages payment processing. You are responsible for any fees charged by Stripe and for the accuracy of your Stripe account information.

5. Platform Fee

Zobooma charges a 2% platform fee on each verified contract payout. The fee is deducted from the marketer's payout at the time of release; the marketer receives 98% of the verified amount. The business pays the full contract amount into escrow; the fee applies only when funds are released to the marketer upon successful verification.

6. Contracts and Arbitration

Contracts created on Zobooma are binding agreements between the parties. Verification of achievement is performed by automated arbiters using third-party data. Zobooma does not guarantee the accuracy of arbiter data sources. Disputes may be escalated per the dispute process outlined in the contract. Zobooma reserves the right to intervene in disputes but is not obligated to do so.

7. Prohibited Conduct

You may not use the Service for illegal purposes, to defraud others, or to manipulate arbiter data. You may not create contracts for prohibited content (e.g., illegal goods, hate speech, malware). Violation may result in account suspension or termination.

8. Limitation of Liability

Zobooma is provided "as is." We do not warrant uninterrupted or error-free operation. To the maximum extent permitted by law, Zobooma and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

9. Changes

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via email or in-app notice where practicable.
